Respected appellate attorney, mediator and arbitrator Deborah Hankinson, founder of Dallas-based appellate boutique Hankinson LLP, has been named one of the Top 3 lawyers in the state by Texas Super Lawyers magazine, published by Thomson Reuters.

Having been named one of the state’s top lawyers each year since the inaugural publication in 2003 and ranked among the Top 3 in Texas three times now, Ms. Hankinson is one of Texas Super Lawyers’ most honored attorneys. A former Texas Supreme Court justice, she is regularly recognized among the Top 10 attorneys and Top 50 women attorneys in Texas, and among the Top 100 in Dallas-Fort Worth.

In a precedent-setting case, Deborah Hankinson, Stephanie Nelson, and Brett Kutnick successfully defended Anadarko E&P Onshore against Lightning Oil Company’s claims for subsurface trespass and tortious interference with contract.

The Texas Supreme Court unanimously ruled that Anadarko did not commit an actionable trespass by drilling, with permission of the surface estate owner, through Lightning’s mineral estate.

“The prevalence of off-site drilling in Texas makes this one of the Court’s most significant oil-and-gas opinions in recent years,” notes Ms. Hankinson.

In the May 19, 2017, story “Texas Justices Side With Anadarko in Drilling Trespass Row” detailing the ruling, the national legal news service Law360 wrote that “Lightning owns the rights to the oil and gas beneath the Briscoe Ranch in the Eagle Ford Shale play, and had argued it must grant consent before Anadarko can drill through that property to reach Anadarko’s mineral lease.”

The article noted that “Anadarko had argued it didn’t have to strike a deal with Lightning because it secured permission from the ranch” to drill its horizontal well that would bottom on Anadarko’s own mineral estate. The court agreed with Anadarko, holding “the individual interests in the oil and gas lost through being brought to the surface as part of drilling a well are outweighed by the interests of the industry as a whole and society in maximizing oil and gas recovery.”

The court also held that Lightning had failed to demonstrate that Anadarko’s off-site drilling would interfere with Lightning’s development of its own mineral estate.

Texas Supreme Court Grants Mandamus Relief, Vacates New Trial Order

Deborah Hankinson, Brett Kutnick, and Jennifer Stagen won a mandamus victory in the Texas Supreme Court for client Dean Davenport in a dispute originally brought by his former attorneys in 2012.  The attorneys claimed that under a contingency fee agreement they were owed a percentage of Davenport’s company, Water Exploration Co. Ltd., in addition to the monetary fee paid to them.

At the conclusion of a multi-week trial, a Bexar County jury determined that Davenport’s contingency fee agreement did not include giving the attorneys a share in the company.  The jury also found in Davenport’s favor on his affirmative defenses of estoppel and waiver.  The trial court, however, set aside the verdict, granting the attorneys’ request for a new trial.  In making the ruling, the court stated that the evidence was legally and factually insufficient to support the jury’s findings on Davenport’s affirmative defenses and that the agreement provided that fees would be paid out of the ownership in any business recovered.

In its ruling, the Texas Supreme Court held that the trial court abused its discretion in ordering a new trial.  The Supreme Court therefore granted mandamus relief and ordered the trial court to vacate its new trial order and render judgment on the verdict.  According to the June 16, 2017, story “Texas High Court Nixes New Trial in $42M Attys’s Fee Row” by the national legal news service Law360, the Court stated that it “did not believe the new trial order was ‘issued for valid reasons’” and that the attorney-client agreement was unambiguous in stating that the attorneys were only entitled to a monetary recovery for their services.  In re Davenport, No. 15‑0882, ___ S.W.3d ___, 2017 WL 2623070 (Tex. June 16, 2017) (orig. proceeding).

Brett Kutnick, Deborah Hankinson, Jennifer Rangel Stagen, and Stephanie Dooley Nelson successfully represented Eagle Oil & Gas Company (“Eagle Oil”) in the trial court in a second lawsuit filed by TRO-X, L.P. concerning oil and gas interests in the Permian Basin. Following extensive briefing and a hearing, the trial court granted Eagle Oil’s motion for summary judgment on grounds of res judicata, collateral estoppel, the statute of limitations, and waiver, and denied TRO-X’s cross-motion for summary judgment. After a later evidentiary hearing on Eagle Oil’s request for attorney’s fees under the Declaratory Judgments Act, the trial court rendered final judgment that TRO X take nothing on its claims and awarded Eagle Oil attorney’s fees incurred in the trial court in the amount of $175,819.50, plus up to $261,000 in conditional appellate attorney’s fees for representation in the court of appeals and Texas Supreme Court. The case is currently on appeal in the Dallas Court of Appeals. TRO-X, L.P. v. Eagle Oil & Gas Co., No. DC-16-01439, in the 116th Judicial District Court of Dallas County, Texas.

Noted Dallas attorney to receive Distinguished Alumni Award

DALLAS – Former Texas Supreme Court justice Deborah Hankinson will be honored March 30 with the Distinguished Alumni Award during the University of Texas Dallas Awards Gala.

The UT Dallas Distinguished Alumni Award is the highest honor the school can bestow on its alumni and is presented to individuals who are outstanding in their chosen profession or life’s work.

She earned a master’s degree in special education in 1977 from UT Dallas. With that degree, she became the lead teacher of a groundbreaking Plano ISD program for elementary students with developmental disabilities.

“I have been blessed with a very fulfilling legal career, but my work as a teacher was rewarding in a way that is difficult to express, and it was made possible by the education I received at UT Dallas. Not only did my education help make me a better teacher, it helped lay the foundation for my decision to attend law school,” said Ms. Hankinson.

Following her tenure on Texas’ highest court, Ms. Hankinson returned to private practice, founding the Dallas-based appellate law firm Hankinson LLP and becoming one of the most widely respected arbitrators, mediators and appellate lawyers and strategists in the state.

DALLAS – Widely respected Dallas lawyer Deborah Hankinson has earned a Lifetime Achievement Award from the editors of Texas Lawyer in recognition of her career as a Texas Supreme Court justice and her instrumental role in providing legal aid to low-income Texans.

Now focused on alternative dispute resolution and appellate work, Ms. Hankinson was among the attorneys selected in 2016 who have made an indelible mark on the Texas legal profession. Ms. Hankinson served on the Texas 5th District Court of Appeals in Dallas, followed by the Texas Supreme Court, where she served from 1997-2002. Texas Supreme Court Eliminates $9.6 Million Judgment for Injured Worker Based on the Absence of a Duty

In a highly watched case regarding the duties owed by former property owners, Deborah Hankinson, Brett Kutnick, Rick Thompson, and Jennifer Stagen successfully represented Occidental Chemical Corporation and persuaded the Texas Supreme Court to reverse a $9.6 million negligence judgment awarded to a worker who was partially blinded by acid at a chemical plant years after Occidental’s sale of the plant. Specifically, the Supreme Court addressed whether a property owner who allegedly creates a dangerous condition owes a duty in premises liability to warn of the dangerous condition or to make it safe and a duty in negligence to use reasonable care not to create the dangerous condition in the first place. In answering that question in the negative, the Court rejected the notion that a property owner acts as both owner and independent contractor when improving its own property, subjecting itself to either premises-liability or ordinary-negligence principles depending on the injured party’s pleadings. Instead, the Court held that premises-liability principles apply to a property owner who creates a dangerous condition on its property, and that the claim of a person injured by the condition remains a premises-liability claim as to the owner-creator, regardless of how the injured party chooses to plead it. Because Occidental sold the property eight years before the plaintiff’s accident, the Supreme Court held that Occidental owed no duty of care as that duty had passed to its vendee. The Court therefore reversed the court of appeals’ judgment and rendered judgment that the plaintiff take nothing. See Occidental Chemical Corp. v. Jenkins, No. 13-0961, 2016 WL 82662 (Tex. Law partner Rick Thompson also named to 2015 Texas Super Lawyers list

 

Acclaimed appellate attorney, mediator and arbitrator Deborah Hankinson, founder of leading appellate boutique Hankinson LLP, has been named one of the Top 3 attorneys in Texas based on nominations from fellow lawyers in the 2015 edition of Texas Super Lawyers, which recognizes the state’s top legal practitioners.

In addition to the Top 3 ranking, Ms. Hankinson earned her fourth selection among the state’s Top 10 lawyers in the exclusive annual listing based on her work in appellate law. Joining her on the Super Lawyers list this year is firm partner Rick Thompson, who earned his second selection to the list for his representation of clients in appellate cases.

Owned by the news publisher Thomson Reuters, Super Lawyers develops its lists based on nominations from lawyers, assessments by a research team, and final evaluations from lawyers in the same practice areas.

Super Lawyers is an important honor because it relies on input from attorneys just like us,” Mr. Thompson says. “It’s gratifying to know that people who do the same legal work view us as among the best.”

Mr. Thompson, a former Texas Assistant Solicitor General, argued and prevailed in the IT-Davy case involving issues of sovereign immunity before the Supreme Court of Texas. He also played a key role in last year’s decision in Bostic v. Georgia-Pacific, a significant asbestos ruling in which the state’s high court found in favor of his client, Georgia-Pacific.

A former Texas Supreme Court justice and widely respected appellate lawyer and strategist, Ms. Hankinson also mediates disputes and serves as an arbitrator. She is a member of the Board of Directors of the American Arbitration Association.

Former Texas Supreme Court Justice recognized for work in mediation, arbitration

 

Prominent Dallas attorney Deborah Hankinson has been selected to The Best Lawyers in America list for the ninth consecutive year for her appellate work and for the first time for her mediation and arbitration work.

The founder of Hankinson LLP, Ms. Hankinson is a former Justice of the Texas Supreme Court and the Texas Fifth Court of Appeals in Dallas. She has earned selection to Best Lawyers since 2008 and is especially pleased to be honored for a wider area of practice.

“For a while now, I’ve been putting more and more time into my mediation and arbitration practice, so it’s nice to be recognized for achievement in that area,” Ms. Hankinson says. “These kinds of tools, along with the ability to resolve disputes even before a lawsuit is filed, can provide individuals and companies with a more effective means of moving conflicts toward solutions.”

Ms. Hankinson, who sits on the Board of Directors and the Executive Committee of the American Arbitration Association, often serves as a neutral in arbitration proceedings, and she is a sought-after mediator in sophisticated business disputes, complex torts and sensitive employment cases.

She is Board Certified in Civil Appellate Law by the Texas Board of Legal Specialization, a Fellow of the American Academy of Appellate Lawyers and a member of the American Law Institute. In 2014, she served as a faculty member for the College of New Judges, providing training for newly elected judges in Texas.

Rick Thompson and Deborah Hankinson again have been named to D Magazine’s annual list of the Best Lawyers in Dallas.  This is Ms. Hankinson’s tenth year to be included on the prestigious list and Mr. Thompson’s second year to be named.

Hankinson LLP is one of only two firms with multiple attorneys selected to the exclusive listing based on their appellate work.
